Jump ahead to 2008 and

60% of voters were required to pass the amendment in Florida and it was ultimately passed by a margin of 61.9% in favor and 38.1% opposed.

Even though same-sex marriage was already outlawed in Florida,

some feared a court case like Wilson v. Ake might have the audacity to challenge the ban.

In the case of Wilson v. Ake in 2005, a lesbian couple had the courage to try and get their legal marriage from Massachusetts recognized in Florida. Perhaps unsurprisingly, Judge James S. Moody Jr. upheld the ban on same-sex marriage.

Because, you know, keeping love between two consenting adults was just
too much to ask for.
